In terms of the Immigration Act, No.13 of 2002, for a business to get a business VISA they must have the following minimum requirements:

  • The business should be registered with CIPC and company documents to prove the registration.
  • The business must invest R5m originating from outside the republic
  • The business must have a report from accountant confirming the R5m Investment (SAICA or SAIPA member)
  • The business must prepare a BUSINESS PLAN with financial Projections
  • The business must be registered with SARS and have Tax Clearance Certificate.
  • The business must be registered for UIF as an employer and have proof of registration
  • The business must be registered for Compensation Fund on Occupational Injuries and have proof of registration.
  • The business must have atleast 60% South Africans on its staff complement.
  • The business must get a recommendation letter from the DTI endorsing feasibility of the business and its contribution to the national interest.
  • An applicant that invests in an existing business shall provide financial statements for the preceding year.
  • If the business will be importing or exporting goods out of the republic it must be registered with SARS customs office as an importer or Exporter.
